Time Is Of The Essence!
After an injury or accident it is critical that you contact an attorney immediately. Why? Because in legal cases, there is a statute of limitations - a limited amount of time during which you can file a suit. If a government entity is a potential defendant you may have as little as ninety (90) days to file a "Notice of Claim" to preserve your rights to file a lawsuit. Just as important, as time passes, it is less likely that evidence or witnesses will be available to assist in your case. Unfortunately, many people wait until it's too late to file and then regret failing to contact an attorney. Some injured people wait so long that even thought they may still be within the statute of limitations, they have unnecessarily weakened their cases due to the simple passage of time. It costs nothing to consult with an attorney. Anybody who has been injured due to the negligence of another party should consult an attorney if, for no other reason, to prevent the same thing that happened to them from happening to someone else.

Richard J. Aloia In the legal field we call this a "attractive nuisance." Without knowing all the facts, based upon this story, both the MTA and the local government had or should have had knowledge of this foreseeable danger and should be held liable.
